Please note that this course is open to Justice Canada legal professionals only (lawyers, notaries who are members of the Chambre des notaires du Québec and paralegals).

This program is designed to provide practical, end-to-end training on class actions. It will consist of 10 sessions covering the full lifecycle of a class proceeding, from early strategy and certification through to common issues trial, settlement, and implementation. The program is open to all counsel and paralegals, particularly those looking to build expertise in this area, as well as anyone seeking to deepen their understanding of this complex and evolving field.

Session 4: This session will examines the strategic and procedural motions that arise before certification in class proceedings. Participants will explore how pre-certification motion practice can shape the scope, timing, and trajectory of a proposed class action.

Learning Objectives / Topics covered

 By the end of this session, participants will be able to:

• Identify the main types of motions that may arise before certification.
• Explain how courts determine the sequencing of pre-certification motions and certification proceedings.
• Describe the purpose and key considerations of carriage and preclusion motions.
• Recognize the circumstances in which courts may stay parallel or overlapping class proceedings.
• Assess when a motion to strike may be brought and the strategic considerations influencing its timing.
• Understand the role of summary judgment motions in the pre-certification context.
• Identify common procedural motions, including deferral of defence, leave to file additional evidence, and pre-certification discovery.
• Evaluate how pre-certification motions can influence the scope, timing, and efficient management of a class proceeding.
