Description
This course is part of the Nuix Discover series offered by the National eDiscovery and Litigation Support Services (NeDLSS). Nuix Discover is the document review platform used by the Department of Justice. NeDLSS offers three types of courses in the Nuix Discover series: Basics, Analytics, and Case Administration. This course will focus on Nuix Discover Analytics.
This course focuses on the interplay between technology and litigation, and how predictive coding can expedite the document review. Predictive Coding is a type of Technology-Assisted Review that uses algorithms to identify potentially responsive and non-responsive documents. During a document review, a responsive document tends to be responsive or privileged, and a non-responsive document is typically not responsive or not privileged.
The facilitators provide an overview of the advantages and disadvantages of using predictive coding to assist with document review. They also explain how the Nuix Discover predictive coding tool – continuous active learning – functions to identify documents that need closer review by a human expert. The facilitators also emphasize the importance of legal professionals having a reasonable understanding of artificial intelligence and the relevant technology, and how to ensure the use of predictive coding is a defensible process accepted by other parties and the courts.
The Evidence Management Team is the only group at Justice that currently has permission to use predictive coding. This course is very useful for litigation teams working with EvMT in order that they can understand the limits of what predictive coding can accomplish.
