Description

Please note that this course is open to Justice Canada, Office of the Judge Advocate General for the Canadian Forces, and Global Affairs Canada Trade Law Bureau legal professionals only (lawyers, notaries who are members of the Chambre des notaires du Québec and paralegals).

The participants will learn the basic principles and substantive limits governing the making of regulations and other forms of delegated legislation. In particular, they will learn to draft enabling provisions and provide advice on the scope of regulation-making powers.

Topics covered

  • Framework for Regulation-making and Introduction to Understanding and Interpreting Enabling Authorities (Day 1)
  • Implied limits (unreasonableness, bad faith, improper purposes, discrimination uncertainty, transformation and subdelegation of powers) (Day 2)
  • Incorporation by reference (Day 3)
  • Required regulation-making (Day 4)

Registration deadline: 5 working days prior to the course date.
