Description
This workshop will allow participants to further their knowledge concerning remedies that may be granted under s. 24(1) of the Canadian Charter of Rights and Freedoms and s. 52(1) of the Constitution Act, 1982. It will include discussion of general principles, recent cases and emerging issues in this area of law.
Topics covered:
- Brief discussion of general principles of standing in relation to Charter claims
- Relationship between s. 24(1) of the Charter and s. 52(1) of the Constitution Act, 1982
- Remedies for unconstitutional government action under s. 24(1) (e.g., stays of proceedings, Charter damages, etc.)
- Remedies for unconstitutional laws under s. 52(1) (e.g., declarations of invalidity, reading down, suspensions, etc.)
