Description
This course will provide an introduction to federalism and the division of powers in Canada. By the end of the session, participants will understand how legislative and executive power is shared in Canada and how the constitutional division of powers is treated in the courts.
Topics covered
- Constitutional structure of the federation
- Division of legislative and executive powers
- Principles of judicial review on federal grounds, including pith and substance, double aspect and paramountcy
- Review of selected heads of power
- Update on recent and upcoming cases
